Welcome to Realty 9.0. By accessing or using our website and services, you agree to be bound by the following Terms of Service. Please read them carefully. If you do not agree with any part of these terms, you must not use the platform.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Realty 9.0 ("Company", "we", "us", "our"). By creating an account, listing a property, or otherwise accessing any part of the platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

Realty 9.0 is an online real estate platform that facilitates the discovery, listing, and enquiry of residential and commercial properties in Mumbai. We act as an intermediary connecting property buyers, renters, sellers, and brokers. We are not a party to any property transaction and do not own or manage any listed properties.

3. User Accounts

Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Account security

You must notify us immediately at info@realty9-0.com if you suspect unauthorised access to your account. We will not be liable for any loss or damage arising from your failure to safeguard your credentials.

Account termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to Realty 9.0 or other users.

4. Listing and Content Standards

Accuracy

If you list a property on Realty 9.0, you warrant that all information provided — including price, location, dimensions, photographs, and legal status — is accurate, truthful, and not misleading at the time of listing.

Prohibited listings

You may not list properties that you do not have the authority to sell or rent, properties involved in ongoing legal disputes without disclosure, or any content that is fraudulent, defamatory, or violates applicable law.

Photographs and media

By uploading photographs or other media to the platform, you grant Realty 9.0 a non-exclusive, royalty-free, worldwide licence to display that content for the purpose of operating and promoting the platform.

Removal of listings

We reserve the right to remove any listing that violates these Terms, contains inaccurate information, or that we deem inappropriate, without prior notice.

5. Prohibited Conduct

You agree not to:

Misrepresent identity

Impersonate any person or entity, or falsely claim an affiliation with any person, organisation, or brokerage.

Scrape or copy

Use automated tools, bots, or scrapers to extract data from the platform without our prior written consent.

Spam or harass

Send unsolicited communications, spam, or harass other users through the platform's messaging or enquiry features.

Circumvent fees

Attempt to bypass any subscription, listing fee, or payment mechanism associated with premium features.

Introduce malware

Upload or transmit any viruses, malware, or other harmful code.

Violate laws

Use the platform for any purpose that violates applicable law, including but not limited to money laundering, fraud, or discrimination under the laws of India.

6. Broker and Partner Terms

Partner application

Brokers and agents may apply to become verified partners on Realty 9.0. Approval is at our sole discretion and subject to verification of RERA registration and other credentials.

Lead handling

Partner brokers who receive leads through the platform are expected to contact prospective clients promptly, professionally, and in good faith. Misuse of leads, including unsolicited bulk marketing, may result in partner status revocation.

RERA compliance

All broker partners must maintain valid RERA registration and comply with the Real Estate (Regulation and Development) Act, 2016, and all applicable state amendments.

7. Disclaimers

No transaction guarantee

Realty 9.0 does not guarantee the completion of any property transaction. We are a discovery and connection platform only. All negotiations, agreements, and payments occur directly between buyers/renters and sellers/landlords.

Listing accuracy

While we encourage accuracy, we do not independently verify the information in individual property listings. Users are advised to conduct their own due diligence, including physical inspections and legal title checks, before entering into any transaction.

"As is" service

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, Realty 9.0 and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, or goodwill — arising out of or in connection with your use of the platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

9. Intellectual Property

All content, trademarks, logos, design elements, and software on the Realty 9.0 platform are the intellectual property of Realty 9.0 or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our express written permission.

10. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Realty 9.0, you consent to the data practices described in the Privacy Policy.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
